Any representations made by the Presenter with reference to the Event or performance at any time and any associated complaints or claims are the responsibility of the Presenter and not Passion of Expression.
1.3 All Customers attending the Event must hold a valid ticket for the same. Late arrivals may result in non-admittance until a suitable break in performance.
1.4 Nothing in these policies is intended to limit or exclude Passion of Expression's liability, or the liability of a Presenter, under applicable consumer law including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

3. Who You Are Buying From
3.1 Passion of Expression acts as the agent to those who are promoting or otherwise providing the event for which you purchase tickets ("Event Providers"). When you purchase a ticket for the event that is located in New Zealand, then Passion of Expression NZ will be handling the transaction and collecting payment for the Event Provider, and if the tickets are sent they will be sent from New Zealand, when you are making your purchase on the passionofexpression.co.nz website and can only be shipped within New Zealand. passionofexpression.co.nz holds no responsibility if you are overseas and purchase tickets for the Event, prior arrangement must be made for a valid New Zealand address for those tickets to be shipped to .
4. Pricing and Availability
4.1 Passion of Expression.co.nz sells tickets on behalf of promoters, which means passionofexpression.co.nz does not set the ticket prices or determine seating locations. Tickets are generally sold through this website, or through the Even Promoters directly. Therefore, tickets for the event may sell out quickly. There may be the possibility of additional tickets may be available prior to the event. However, passionofexpression.co.nz does not control this inventory or its availability.
5. Order Confirmation
5.1 If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with firstname.lastname@example.org whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. Passion of Expression will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
6. Processing Fees
6.1 Tickets purchased on the Site are typically subject to a per ticket charge and a non-refundable per order Payment Processing Fee. In many cases, delivery prices will also be charged. The per order Payment Processing Fees are calculated as a percentage of the total order value and apply where payment is made via Credit Card, Debit Cards and Gift Cards. The Payment Processing Fee includes (but is not limited to) credit and debit card fees and expenses, administration and associated infrastructure costs for providing these payment mechanisms.
7. Amount of Tickets Per Customer or "Ticket Limits"
7.1 When purchasing tickets on Passion of Expression.co.nz you are limited to a specified number of tickets for each event (also known as a "ticket limit"). This amount is included on the unique event page and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices.
8. Cancelled Event
8.1 There is the possibility that the event may be cancelled or postponed by the promoter due to weather conditions or situations affecting the staff or audience. When this occurs passionofexpression.co.nz makes every effort to ensure you receive a prompt refund if applicable. If the event is cancelled, please Contact us for information on receiving a refund. If the event was moved or rescheduled, the venue or promoter may set refund limitations. Contact us for exact instructions. Please make sure to include/provide your Ticket details so we can expedite your refund if applicable.
8.2 In the event that the Presenter authorises ticket refunds, they will be issued only to the original purchaser or to the original credit card used for the purchase.
8.3 Nothing in this Purchase Policy (including specifically, this clause) shall limit Passion of Expression's or a Presenter's liability for any breach of the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (including any liability for consequential loss suffered by a consumer that cannot be excluded) or will or purport to limit any consumer's rights that cannot be limited by New Zealand Law.
9. Refunds and Exchanges
9.1 Before purchasing tickets, carefully review your event and seat selection. Passion of Expression does not issue an exchange or refund for a lost, stolen, damaged or destroyed ticket (including where a ticket does not arrive in the mail) unless (a) Passion of Expression can identify at the Venue the actual seat corresponding to the ticket for that event, or in the case of a general admission ticket, Passion of Expression is able to identify (acting reasonably) and cancel the relevant ticket, and (b) you give Passion of Expression a reasonable amount of notice ahead of the event that the ticket has been lost, stolen, damaged or destroyed, in which case Passion of Expression will issue a replacement ticket to you for a reasonable administration fee. A change in personal circumstances does not entitle a ticket holder to return or exchange a ticket.
10. Billing Information Verification
10.1 Orders are processed only after a billing address, and other billing information, has been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. In these cases, Passion of Expression customer service will attempt to contact you, using the information provided at the time of purchase. If Passion of Expression is unable to reach you after its initial attempt, Passion of Expression may cancel your order and may sell your tickets to another customer.
11. Delivery of Tickets and Venue Pick Up
11.1 If you have selected delivery through the mail, please allow at least 14 days after your order is made to receive your tickets. Passion of Expression sends tickets via New Zealand post in New Zealand to the billing address of the charge card holder. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. Tickets delivered through Venue Pick Up are typically available one hour prior to the event start time. You will need to present your Passion of Expression.co.nz confirmation number, the credit card used to purchase tickets and picture identification.
12. Multiple Browser Windows
12.1 When ordering tickets online with Passion of Expression, please ensure you are looking for tickets and placing an order using only one browser window. Looking up tickets using multiple browser windows could result in losing your tickets or timer expiration.
13. Limitation of Liability
13.1 Balls and other objects may fly into the spectator area during an event. Despite spectator shielding, injury can occur. Stay alert at all times before, during and after the performance. If struck, immediately ask usher for directions to a medical station. By purchasing a ticket through Passion of Expression, you agree to the terms of this Purchase Policy on behalf of yourself and any accompanying minor. You assume all risks incidental to the event for which a ticket is issued, whether before, during or after play or performance, except that nothing in this section limits your rights and remedies under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986
14. License; Ejection and Cancellation; No Redemption Value
14.1 Event Providers reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with Event Provider rules. A ticket is a revocable licence and breach of terms or rules will terminate your license to attend the event without refund. A ticket is not redeemable for cash.
14.2 The Presenter reserves the right to add, withdraw or substitute artists provided that it does not cause a fundamental change in the characteristics of the event for which tickets are purchased; vary advertised programmes, seating arrangements and audience capacity, refuse admission with reasonable cause or to request a customer leave the venue if disrupting others.
15. Recording, Transmission and Exhibition
15.1 You agree not to record or transmit, or aid in recording or transmitting, any description, account, picture, or reproduction of the event. You grant permission to utilize your image, likeness, actions and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) in any medium or context without further authorization or compensation.
15.2 Cameras, video and audio recording devices, mobile phones and pagers may not be permitted at the venue. The Presenter may request that all pagers and mobile phones be turned off before entry.
15.3 The Presenter reserves the right to remove a ticket holder from the event without compensation for breach of any rules in this clause.
16. You Are Subject to Search
16.1 You and your belongings may be searched on entry. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, bundles and containers.
